Transparency International has linked the construction of the residential complex “On Ivanovskaya” near Dubki Park in the north of Moscow to the vice-mayor for construction Marat Khusnullin, the organization’s investigation was published on its website.

Thus, Khusnullin and his adviser Minnikhanov have a close relationship, which is confirmed by the latter’s status as an adviser to the deputy mayor and participation in joint business projects with the family of the deputy mayor of Moscow.
The organization explained that Khusnullin actually heads the Urban Planning and Land Commission (GZK) - formally an advisory body. It was the GZK that made it possible to change the target direction of the site.
“We believe that in the situation we are considering, Marat Shakirzyanovich Khusnullin and Ildus Zamilevich Minnikhanov are bound by obvious obligations. In accordance with the Law “On Anti-Corruption”, a conflict of interest is understood as a situation in which the personal interest (direct or indirect) of a person holding a public position of a subject Russian Federation influences or may influence the proper, objective and impartial performance of his official duties. And already on September 9, 2015, the Moscow City Property Department issued an order (pdf), according to which the purpose of providing a land plot changed from “provided for the implementation of educational activities” for “design and construction (reconstruction) of capital construction projects.” Thus, the department allowed the construction of a residential complex on the site of the kindergarten just two months after Tsentrograd LLC, the offshore company and Mrs. Tsvetkova became the founders of the development company.
Just a month later, on October 8, 2015, by order (pfd) of the Moscow Department of City Property, the Residential Complex on Ivanovskaya was granted an installment plan for rent of more than 420 million rubles for three years. Almost immediately after this, Tsentrograd LLC left the founders of the Na Ivanovskaya residential complex.

To understand how the “Residential Complex “On Ivanovskaya”” managed to do this, we figured out the decision-making mechanism of the Moscow Government in the field of land use.

In 2010, the Urban Planning and Land Commission (ULC) was created in the capital. Formally, the SLC is only an advisory body, but in reality it has very broad powers. The State Land Control Committee issues mandatory instructions to Moscow executive authorities on a weekly basis.It is on the basis of the decisions of the State Land Committee that all further land and urban planning documents are approved. Without it, you cannot obtain a construction permit or an order to change the purpose of providing the site. The commission does not publish its protocols, does not publicly report on the work done, with the exception of meager news items on the Moscow government website. Formally, the State Construction Committee is headed by Mayor Sobyanin, but actual preparation and decision-making is supervised by the Vice Mayor for Construction Marat Shakirzyanovich Khusnullin. We were surprised by the incredible speed of the commission’s work: on September 18, 2014, the State Land Committee met for a regular meeting, where it managed to consider 61 working issues in one hour. Among these issues was the decision to change the purpose of the land plot on Ivanovskaya Street, already known to us.
It seems doubtful that the chairman of the State Land Committee delved deeply into the essence of the issues discussed at the meeting. According to the information we have, it was Mr. Khusnullin and his subordinate, Chairman of the Committee on Architecture and Urban Planning Yuliana Vladimirovna Knyazhevskaya, who presented the investment project “Residential Complex on Ivanovskaya” at the State Land Committee meeting.
From the presentation it is clear that the developer already has plans for the neighboring site, where the Treasure Island kindergarten is still operating.

From June to November 2015, Tsentrograd LLC is included in the share of the authorized capital of the Residential Complex on Ivanovskaya in the amount of 15%.
During these few months, key events took place for the developer: he managed to change the purpose of the land plot and obtain an additional agreement to the land lease agreement. The developer also received a deferment of payment of 400 million rubles under the lease agreement for a three-year period.
Since the change in its intended purpose, the cadastral value of the land has tripled - from 145 to 517 million rubles.
Thus, at the time of the sale of Tsentrograd LLC its share in the authorized capital of the Residential Complex on Ivanovskaya, 15% of Maksat Shemmedov was worth approximately 77 million rubles. The actual amount of the transaction could have been significantly higher.
On a specialized website for investor-developers, it is indicated that the transaction price for the sale of the project “Residential Complex “On Ivanovskaya” after receiving permits for the project exceeds 1 billion 600 million rubles. In this case, the income of a 23-year-old entrepreneur could reach 240 million rubles.
How did a recent student manage to become the founder of a one and a half billion development project in the green zone of Moscow?

We assess this story as a rather complex example of a corporate conflict of interest for the Deputy Mayor of Moscow. An attempt to confuse the billion-dollar story by including a 23-year-old businessman who had not previously been involved in business in the scheme clearly signaled to us that there was a suspicious transaction. If we analyze all the investment contracts concluded by the Moscow Government, we can confidently say that there are more interesting examples of stories with corruption “indicators”. This is why investment contracts are not publicly available.
In this situation, one can discern a conflict of interest undeclared by the Deputy Mayor of Moscow, which is a violation of the Federal Law “On Combating Corruption.”
Conclusions
1 The value of the 15% share in the development company received by a relative of advisor Khusnullin was in monetary equivalent equal to 240 million rubles.
