The situation “from maternity leave to maternity leave” often gives rise to questions about the benefits that will be provided in connection with the birth of a second child. Let's figure it out:
What is the most profitable way to receive benefits under B&R in a situation “from maternity leave to maternity leave”?
Event options for mothers on maternity leave at their place of work (on maternity leave for a child under 3 years old):
1. You have more than 6 months of experience.
1.1. You don't go to work, you stay at home.
The maternity benefit will be calculated based on your tariff salary (without allowances and increases) at the beginning of the month in which sick leave for pregnancy is open. During this entire period, you will have 100% child care benefit for a child under 3 years old, with whom you are on maternity leave.
We estimate the amount like this and find out our salary in the accounting department. In the end there will be about 4 salaries.
For example, salary 2 million, sick leave from October 10, 2014 for 126 days until February 12, 2015 inclusive:
We divide the salary amount by the number of calendar days in the month of sick leave and multiply by the number of missed calendar days. And so on for each month separately. We add up the result.
2 million/31*22+2 million/30*30+2 million/31*31+2 million/31*31+2 million/30*12=8,219 t.r.
Cons- the most losing option in terms of money.
Pros— no need to go to work, leave the child and run around filling out documents.
1.2. You go to work.
You need at least 30 calendar days before the month of going on sick leave (six months before going on sick leave). It is not necessary to work until sick leave.
This is more profitable than the first point if, in addition to the tariff salary (without allowances and increases), you have bonuses (at least for contract work, for category, for length of service). Usually there are these allowances.
And since bonuses often go into the next month, it is more profitable to work 2 or more months before sick leave. But you will lose 50% of your child care benefits under 3 years of age. Except in some cases. (see below )
Cons— you need to take the child somewhere, fill out documents and go to work. If an employee was hired to take your place during your maternity leave, there will be a problem with this person’s employment. According to the law, he must be fired, and when you go on maternity leave again, he will be hired again. But he will lose continuous service and money too.
Pros- the most profitable option of all.
According to the law, you can leave / leave parental leave for a child up to 3 years old as many times as you like and for any period of time:
Labor Code of the Republic of Belarus Article 185. Working women, regardless of length of service, at their request, the employer is obliged to provide, after a break in work caused by childbirth, leave to care for a child until he reaches the age of three years with a monthly payment for this period state benefit, the amounts and terms of payment of which are established by law.
The leave provided for in this article is granted upon a written application from the child’s mother and can be used by her in full or in parts of any duration.
We are writing an application to go back to work: “I ask you to interrupt your care leave until the child reaches the age of 3 years and be considered to have started working full-time from x.x.x”
In this case, the amount of the B&R benefit greatly depends on the salary, the amount of bonuses, and the duration of work.
1.3. You don't go to work, but you take labor leave in one of the 6 months preceding the month of issue of sick leave according to the BiR.
23. If the number of calendar days of the billing period, taking into account the second part of paragraph 22 of these Regulations, is less than 30 calendar days, benefits are calculated based on the tariff rate (salary) (without allowances and increases) of the employee established on the day the right to benefits arises ( hereinafter - the tariff rate (salary), or based on the average earnings saved during labor and social (in connection with training) vacations, maternity leave, temporary disability (hereinafter - the average earnings) (according to a more profitable option). part one, paragraph 23 as amended by the resolution of the Council of Ministers dated June 12, 2014 N 568)
Calculation of the B&R benefit in this case goes according to average saved earnings.
According to paragraph 15 of the Instruction on the procedure for calculating the average earnings retained in cases provided for by law, approved by Decree of the Ministry of Labor of the Republic of Belarus dated April 10, 2000 N 47 (hereinafter referred to as the Instructions), the average earnings retained by a woman during the vacation granted immediately after the end of the vacation child care up to three years old, is calculated based on wages accrued for 12 calendar months (from the 1st to the 1st day) preceding the month of the start of parental leave, regardless of the working year for which the leave is granted.
These months will also include salary for time worked. Months in which there were sick days (sick leave for sick leave is excluded from the calculation - introduced from July 25, 2014) The average earnings for that period will be updated to the 1st category tariff rate in effect on the first day of the month in which the person goes on vacation.
To do this you need to write 3 statements:
1 — “I ask you to interrupt your care leave until the child reaches the age of 3 years and be considered to have started working full-time from x.x.x”
2 - “Please provide labor leave from x.x.x to x.x.x”
3 — “Please provide me with parental leave until the child reaches the age of 3 years from x.x.x “
If I already took leave before maternity leave, will they give it now?
You need to clarify the number of vacation days that you have with the HR department. And they can happen even if you took a vacation before the sick leave, because... The time of the first sick leave for pregnancy and childbirth, which is 4 months, is included in the working year and for them you are entitled to several days of leave. Suppose the entire vacation is 24 days, then for 4 months = 24/12 * 4 = 8.
If there are no days at all (you chose those 8 days in advance), but you will again accumulate days for the period of this new sick leave! You can take them in advance, according to Article 168 of the Labor Code of the Republic of Belarus, if your working year has already begun (check with the HR department).
Article 168. Sequence of granting labor leaves
When drawing up a vacation schedule, the employer is obliged to schedule vacation at the request of the employee:
in a certain period:
5) women before or after maternity leave;
How profitable is it to take a vacation?
Calculation of the salary allowance for the BiR: Salary 1,326 thousand rubles, the amount of the allowance for the BiR is approximately 5,300 thousand rubles.
Calculation of benefits based on the average saved. Allowance for accounting 9 165t.r.
Benefit in the amount of 3,865 rubles.
2. Before your first maternity leave total experience less than 6 months
For example, you immediately got a job after university and went on maternity leave.
2.1. You don't go to work, you stay at home.
Then you have a minimum allowance- based on ½ BPM per month. To you It is not profitable to receive benefits under the BiR! In this case, we do not take sick leave according to BiR (you can refuse it from the gynecologist), and after giving birth we carry documents to work and receive from the day of birth of the child a care allowance for up to 3 years (which is 4 times more per month than the minimum according to the BiR manual).
Amount of benefit: If the benefit is for BiR, then for 4 months there will be 2.4 million, if without it, then for 4 months there will be 2 care benefits (for 2 months after childbirth), that’s 4.8 million. (Calculation based on amounts as of October 2014.)
2.2. You go to work and work so much that you have a total of 6 months of experience
Here the situation is similar to paragraph 1.2. the only difference is that you do not need to work 30 calendar days, but as much as is not enough for up to 6 months.
Persons for whom or for whom compulsory social insurance contributions (hereinafter referred to as insurance contributions) were paid in accordance with the law less than 6 months before the emergence of the right to benefits, benefits are assigned in the minimum amount (50% of the largest subsistence level budget on average for per capita, approved by the Council of Ministers of the Republic of Belarus, for the last 2 quarters relative to each month in which temporary disability or maternity leave took place)

It was pleasant and stress-free in all respects, and the big plus was the salary in dollars (we had dollar loans). It became stressful when I had to go out for the full day. You come home after the dubious pleasure of storming traffic during rush hour, and there are little ones who missed their mother, eager to make up for the time of my absence. And I still have all my homework ahead of me. True, with the older ones it was easier - my mother’s friend drove, and my mother, who was sitting with the youngest, picked her up from kindergarten.
I worked full-time for 4 months, then because of the crisis I was laid off, which I don’t regret one bit: I work as a freelancer, teach courses, plus students - a free schedule and a lot of time for the children and for myself. We get a lot done with the girls together - at the skating rink, on sleds, with horses, and in creative joint activities. Plus, I have the opportunity to leave a sick child at home and receive complete treatment. We also spent 2 months in the summer at a dacha outside the city and a month at sea.
The downside is that the income is unstable, but spending, for example, on my clothes is significantly less compared to office times.

Alas, leaving maternity leave early has its downsides. The child loses his mother’s attention too early, because you can sit with him for up to three years. Finding himself in new conditions and experiencing stress, the baby can react to all this with illnesses, whims, insufficient development, etc.
Everything is spelled out in the labor code. If you don’t understand this topic in time, then if you go to work early, you may lose child benefits for up to one and a half years.
Returning to your old place, you suddenly feel superfluous. A lot has changed in the team since you went on maternity leave. And how can you fit into the general regime when there are such overloads at home?
The manager and colleagues look without much optimism at the work schedule you have rearranged in order to feed the baby, go with him to kindergarten, to the hospital, etc. It is unlikely that they will like frequent sick leave.
It is clear that hitches can also happen with household chores. But the most unpleasant thing is that you may not find where to take your child. A grandmother or nanny will be a solution, but with its own nuances. As in the situation with kindergarten, the consequences of the child’s adaptation, etc.
So is it worth leaving early on maternity leave?
As you can see, there are pros and cons here. Much depends, of course, on the other half. If the husband does not agree for the child to go to kindergarten or sit with someone else's aunt, there is no point in arguing. Unless you present him with arguments in favor of your going to work.

The duration of maternity leave does not depend on length of service at a particular enterprise. Also, an employee can immediately after maternity leave take parental leave, first up to one and a half years, and then extend it until the child reaches three years of age.
During the maternity leave of the main worker, management has the right to hire another employee under a fixed-term contract. A woman who has gone on maternity leave retains her place.
Let's take a closer look at what the maternity rate means and what its features are. This is a period of temporary performance of duties by a newly hired employee during the absence of the main one due to the latter being on maternity leave.

The contract, which is concluded by a person replacing an employee who has gone on maternity leave, should not have a specific end date.
It indicates a certain event - the employee’s exit from maternity leave, since the worker can return to work at any time before the expiration date maternity leave, and the exact date cannot be determined.
The law provides for the possibility of an employee returning from maternity leave early to the same position.
The replacement employee is hired according to the staffing schedule. The employer has the right to hire a new worker to the company and transfer an existing employee from his organization to maternity leave.
A fixed-term employment contract is concluded with the new worker and a hiring order is issued. They also make an entry in the labor record and create a personal card.
If an internal transfer to a maternity rate is carried out while maintaining the main place of work of the current worker, the employer enters into a contract with him additional agreement to the employment contract indicating the following fact: the employee performs new duties until the employee who went on maternity leave goes on maternity leave.
In addition to the agreement, an order for temporary transfer is issued. It is not necessary to include the corresponding entry in the work record.
The question often arises whether a pregnant woman can be fired from maternity leave.
If a temporary worker also intends to go on maternity leave or has already left, she cannot be fired by law until her maternity leave ends.
However, a woman will be able to go on vacation and receive the required payments only if she manages to bring in sick leave before the main employee returns to work.
If the latter’s maternity leave lasts three years, then the temporary worker can also take parental leave. The length of service is maintained and payments are accrued. The benefit is paid once at the beginning of the mother's leave.

Conventionally, we divided the father’s vacation registration into 2 stages. At the first stage a potential “maternity” dad should contact his employer. An employer does not have the right to refuse a man his legal request. He is obliged to arrange maternity leave for the father and pay appropriate compensation. But to do this, the man, in turn, is obliged to provide the employer with a certain list of documents necessary to apply for maternity leave. Namely:
- Application for parental leave . There is no specific form in which this statement is written. The structure of the application is practically no different from an application for regular leave. This document must indicate the duration of the vacation.
- A certificate that will confirm that the child’s mother did not exercise her right to this type of leave , did not receive any monetary compensation.
- Certificate and its copy of the child’s birth.
- Application for benefits.
At the second stage the employer, having read the application, is obliged to hand over to the “maternity dad” copies of orders and statements signed by him. As well as a document that will indicate the following information: the period of maternity leave, the amount of compensation and the timing of their payments. If it is necessary to extend parental leave, the employer will need to provide medical certificates from the children's clinic.
A maternity father, like a mother, is granted parental leave for a period of three years . The start date of the leave is considered to be the day the mother’s maternity leave ends. The end date of the vacation must be indicated in the order. The employer is obliged to pay the man all the benefits provided to him by law. And also guarantee him the safety of his position.
